Official Rules

OVERVIEW: The promotion will consist of two (2) components: a contest (“Contest”) and a sweepstakes (“Sweepstakes”) (collectively referred to as the “Promotion”).

ELIGIBILITY: The Promotion is open to legal residents of the fifty (50) United States, the District of Columbia and Canada (excluding the Province of Quebec) (“Eligible Territory”) who are twenty-one (21) years of age or older as of date of entry. Employees, officers & directors of Marriott International, Inc. (“Sponsor”), teamDigital Promotions, Inc. (“Administrator”), the NFL Entities (as defined below) & each of their respective parent companies, subsidiaries, affiliates, related entities, partners, partnerships, principals, representatives, successors & assigns, & advertising/promotion/administrative agencies (collectively “Released Parties”) & their immediate family members (spouse, parent, child, sibling & their respective spouses, regardless of where they reside) & those living in their same households, whether or not related, are not eligible to participate or win a prize. Void outside the Eligible Territory and where prohibited or restricted by law, rule or regulation.  All applicable provincial, federal, state and local laws apply. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Twitter, Instagram or TikTok. You are providing your information to the Sponsor and not to Twitter, Instagram, or TikTok. The information you provide will only be used for Promotion purposes.

CONTEST SUBMISSION PERIOD: The Contest submission period begins at 12:00:00 p.m. (noon) Eastern Time (“ET”) on 9/8/22 and ends 11:59:59pm ET on 3/15/23 and will be divided into three (3) contest submission periods (each hereafter, a “Contest Submission Period”) as outlined in the chart below. Each Contest Submision Period will begin at 12:00:00 a.m. ET and end at 11:59:59 p.m. ET with the exception of the Fansgiving Contest Submission Period which will begin at 12:00:00 p.m. (noon) ET and end at 11:59:59 p.m. ET.

SWEEPSTAKES PERIOD: The Sweepstakes period will begin at 12:00:00 p.m. (noon) ET on 9/8/22 and end at 11:59:59 p.m. ET on 11/18/22 (hereafter, “Sweepstakes Period”).

HOW TO PARTICIPATE:

Contest:

To participate, entrants will be prompted to submit either a 60-second video OR a photo with a short story (with maximum length of the short story not to exceed the limitations set forth by the applicable social channel) relevant to the theme indicated above (“Theme”) (hereafter, each a “Submission”) using any one (1) of the following three (3) methods:

1. Twitter: Tweet your Submission via your Twitter account using the hashtag #CourtyardFanContest (the “Twitter Hashtag”) to receive one (1) entry. Any video/photo and short story on Twitter tagged with the Twitter Hashtag may be eligible for entry into the Promotion. Your Submission must include the Twitter Hashtag in order to be eligible. Use of the Twitter Hashtag constitutes your unconditional acceptance to these Official Rules. By using the Twitter Hashtag in connection with your tweet, you are acknowledging and agreeing that Sponsor has the right to stream your post through the Twitter API or otherwise use your tweet as set forth herein;
2. Instagram: Post your Submission on Instagram through your Instagram account using the hashtag #CourtyardFanContest (the “Instagram Hashtag”) to receive one (1) entry. Any video/photo and short story tagged with the Instagram Hashtag on Instagram may be eligible for the Promotion. Your Submission must include the Instagram Hashtag in order to be eligible. Use of the Instagram Hashtag constitutes your unconditional acceptance to these Official Rules. By using the Instagram Hashtag in connection with your Instagram post, you are acknowledging and agreeing that Sponsor has the right to stream your post through the Instagram API or otherwise use your post as set forth herein; OR
3. TikTok: Once you create a Submission on TikTok using #CourtyardFanContest, visit www.courtyardfancontest.com (hereafter, “Site”) using your personal computer or mobile device during the Contest Submission Period and follow the instructions provided to complete and submit the registration form, paste the direct link to your TikTok Submission, and submit. NOTE: Only videos will be accepted on TikTok. If a short story is submitted along with a video, the short story will not be judged as part of the Submission.

Sweepstakes: Entrants who submit their Submission during the Sweepstakes Period will automatically receive one (1) entry into the Sweepstakes. NOTE: Submissions will not be judged for the Sweepstakes portion of the Promotion and content in a Submission will not impact your chances of winning (so long as Submission complies with the Submission Requirements outlined below).

Limit one (1) Submission per person per Twitter account, per Instagram account, and per TikTok account per Contest Submission Period (for a maximum of three (3) total Submissions throughout each Contest Submission Period). By submitting a Submission, entrant hereby warrants and represents that the Submission conforms to the following submission requirements (hereafter, “Submission Requirements”): Submissions must be the original work of the entrant, may not have been previously published, must not have won previous awards, must not be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these rules. In addition, Submissions cannot include any third party intellectual property, general property, likeness or imagery (other than what has been expressly provided/approved by Sponsor and NFL Team names, logos or slogans). Submission cannot defame or invade intellectual property rights of any person, living or deceased, or otherwise infringe upon any copyrighted, trademarked, or patented works or person’s personal or proprietary rights. If a Submission contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties (other than what has been expressly provided/approved by Sponsor and NFL Team names, logos or slogans), the entrant is responsible for obtaining, prior to submitting the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Submission. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting a Submission, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Submission consent to the Submission and use of the Submission in the Promotion and to its use as otherwise set forth herein. Any Submission that does not conform to the Submission Requirements listed above will be void.

FINALIST DETERMINATION: At the conclusion of each Contest Submission Period, Sponsor and its designees, whose decisions will be final and binding in all matters relating to this Promotion, will judge each Submission based on the following criteria: 1) Level of Originality (50%), 2) Quality of Submission (20%), and 3) Relevance to Theme (30%) (the “Judging Criteria”). In the event of a tie, such tied Submissions will be re-judged based on the following criteria: Creativity: 100%. The entrants who submitted the applicable number of top scoring Submissions in each Contest Submission Period as outlined above, as determined by Sponsor in its sole discretion, will each be deemed a potential finalist. Potentail finalists will initially be contacted by Twitter, Instagram, comment post and/or email and will be required to respond using that contact information provided in the direct message/comment post/email within one (1) day of notification. Upon responding, potential finalists will be required to execute and return an Affidavit of Eligibility and a Release of Liability and (where legal) Publicity Release within one (1) day of notification. Noncompliance with any of the foregoing, with these Official Rules, the inability to contact a potential Finalist within a reasonable time period (or if applicable, schedule and complete the interview), a potential finalist’s inability to to return the required documents within the specified time period, or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, a runner-up being chosen. Only after verification of eligibility and compliance with these Official Rules will a potential finalist be declared an official finalist (hereafter, “Finalist”). Upon verification of the Finalist(s) for each Contest Submission Period, each Finalist will receive a Finalist Prize (with the exception of the Finalist(s) who are ultimately determined Grand Prize winners (who will not receive a Finalist Prize). In the case of the Finalists in the Super Bowl Sleepover Submission Period (“Super Bowl Finalists”), Finalists will then move onto the Interview Phase outlined below.

NOTE: In addition to maintaining compliance with the Submission Requirements above when submitting a Submission, entrants should conduct their social media activity consistent with the parameters outlined in these Official Rules. In the event an entrant is understood to be publishing immoral, obscene, profane, harassing, threatening or disparaging content, messages or any content not in keeping with Sponsor’s image, Sponsor reserves the right the disqualify an entrant and his/her corresponding Submission(s).

FANSGIVING WINNER DETERMINATION

On or about 10/15/22, a separate panel of qualified judges, determined by Sponsor in its sole discretion, will judge each of the Fansgiving Finalists Submissions using the Judging Criteria as set forth above. The five (5) Submissions receiving the five (5) highest scores, as determined by the judges in their sole discretion, will be deemed the Fansgiving Grand Prize winners, subject to verification of eligibility and compliance with these Official Rules. Fansgiving Grand Prize winners will be notified on/about 10/26/22.

SUPER BOWL SLEEPOVER WINNER DETERMINATION

1. Super Bowl Finalist Interview Phase: Upon verification of the Super Bowl Finalists, the Sponsor will schedule recorded phone interviews. The interviewer(s) (hereafter, “Interviewer(s)”) hosting the interview of the Super Bowl Finalists are determined by Sponsor in its sole discretion. The interview with each Super Bowl Finalist will be approximately the same length of time, and the questions asked of each will be the same. All interviews will be recorded and must be completed within a timeframe determined by Sponsor.
2. Super Bowl Winner Determination: Upon completion of all interviews, a panel of judges determined by Sponsor in its sole discretion will judge each of the recorded interviews based on the Judging Criteria outlined above. At the conclusion of the Interview Phase, a panel of judges determined by Sponsor in its sole discretion will judge each of the Super Bowl Finalist Submissions on or about 12/15/22 by ranking each Super Bowl Finalist Submission from one (1) through three (3) (with three (3) being the highest ranked) based on the following: (i) the score received in the Finalist Judging; (ii) the Interview(ers) ranking of the interviews based on presentation; and (iii) the effort put forth by the entrant in their Submission / Interview. Each of the three (3) rankings will carry equal weight. The highest ranked Super Bowl Finalist Submission will be determined the Super Bowl Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules.

DRAFT PRIZE WINNER DETERMINATION

On or about the 3/20/23, a separate panel of qualified judges, determined by Sponsor (in its sole discretion), will judge each of the Draft Finalists Submissions using the Judging Criteria as set forth above. The one (1) Submission receiving the highest score, as determined by the judges in their sole discretion, will be deemed the Draft Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules.

The Fansgiving Grand Prize winner, the Super Bowl Grand Prize winner and the Draft Grand Prize winner may collectively hereafter be referred to as the “Grand Prize winners”.

Neither Sponsor, nor anyone acting on its behalf, will enter into communications with any entrant regarding the Promotion other than to notify the potential Finalists, Grand Prize winners, or Sweepstakes winners. Each Grand Prize winner’s guest(s) must be a legal resident of the fifty (50) United States, the District of Columbia, or Canada (excluding the Province of Quebec), twenty-one (21) years of age or older and must execute and return a Liability and (where legal) Publicity Release prior to issuance of travel documents. Non-compliance with the foregoing, with these Official Rules or return of prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion and time permitting, awarding of prize to the next runner-up. Sponsor reserves the right to conduct background check(s) of any and all records of any potential Grand Prize winner and his/her guest, including, without limitation, civil and criminal court records and police reports, and participation in the Promotion constitutes entrant’s permission for Sponsor to conduct such background check(s), provided that, to the extent additional authorization is necessary under law, potential winners and his/her guest(s) shall authorize such check(s). Sponsor reserves the right (at its sole discretion) to disqualify any potential Grand Prize winner at any time prior to prize fulfillment based on the results of such background check(s) or failure of a potential winner to properly authorize such check(s).

SWEEPSTAKES WINNER SELECTION/NOTIFICATION: On or about 11/21/22, three (3) Sweepstakes Prize winners will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period. Sweepstakes Prize winners will be contacted by Twitter, Instagram, comment post and/or email and will be required to respond using that contact information provided in the direct message/comment post/email within two (2) days of notification. Upon responding, Sweepstakes Prize winners will be required to execute and return an Affidavit of Eligibility and a Release of Liability and (where legal) Publicity Release within two (2) days of notification. If required in the Eligible Territory, a potential winner will be required to answer correctly, without assistance of any kind (mechanical or otherwise), a time limited mathematical skill testing question which will be administered by Sponsor by telephone at a mutually agreeable time. If a potential Sweepstakes Prize winner fails to respond within the specified time period or cannot be contacted; fails to answer correctly the skill testing question as determined by Sponsor in its sole discretion, is ineligible according to these Official Rules; fails to return the required documents within the specified time period; or Sponsor’s sending of the required documents are returned as undeliverable; if any potential winner decides to decline a prize for any reason whatsoever; or if any potential winner otherwise fails to fully comply with these Official Rules, they will forfeit their prize and the prize at hand may be awarded to an alternate winner from among all remaining eligible entries received, at Sponsor’s sole discretion. Odds of winning a Sweepstakes Prize will depend on the number of eligible entries received.

ARV: $3,500 each.
Super Bowl Sleepover	One (1) winner will receive a 6-day/5 night trip for winner and three (3) guests to attend Super Bowl LVII. Trip includes: a) round trip coach air transportation from a major U.S. gateway airport nearest winner's residence in the U.S. to Arizona, b) standard double-occupancy hotel accommodations (one (1) room) at a Courtyard Hotel (or similar Marriott International brand hotel) for five (5) nights; c) one-night accommodation (double occupancy for winner and one (1) of their guests) inside a custom-built suite within State Farm Stadium on February 12, 2023; d) ground transfers to/from the airport/hotel/State Farm Stadium; and e) admission for winner and three (3) guests to Super Bowl LVII. ARV: $20,000.
Draft	One (1) winner will receive a 5-day/4-night trip for winner and one (1) guest to attend the 2023 NFL Draft in Kansas City.  Trip includes a) round trip coach air transportation from a major U.S. gateway airport nearest winner's residence in the U.S. to Missouri; and b) standard double-occupancy hotel accommodations (one (1) room) at a Courtyard Hotel (or similar Marriott International brand hotel) for four (4) nights. ARV: $3,500.

Thirteen (13) Finalist Prizes: Each Finalist will receive one (1) $100 Courtyard gift card. Approximate Retail Value (“ARV”) of each Finalist Prize = $100. Certain terms and conditions may apply to gift card at the discretion of the issuer. No gift card will be replaced or replenished if it is lost, stolen, damaged, destroyed or used without winner’s permission and will be voided if altered or defaced.

Three (3) Sweepstakes Prizes: Each Sweepstakes Prize winner will receive a trip for winner and one (1) guest to a 2022 regular season NFL game of winner’s choice (subject to availability and blackout dates). Trip includes a) round trip coach air transportation from a major U.S. gateway airport nearest winner's residence in the U.S. to destination city, b) standard double-occupancy hotel accommodations (one (1) room) at a Courtyard Hotel (or similar Marriott International brand hotel) for one (1) night; and c) two (2) tickets to the game. ARV: $1,000 each.

For Grand Prize winners and Sweepstakes Prize winners: Actual value of each trip may vary based upon location of winner’s residence. All prize details are at Sponsor’s sole discretion, including but not limited to, exact seat locations at game and amenities/accommodations provided. If winner resides within a one hundred fifty (150) mile radius of the destination, ground transportation (or other form of transportation) may be provided in lieu of air transportation at Sponsor’s sole discretion, and no compensation or substitution will be provided for difference in prize value. Trips must be taken on dates designated by Sponsor or prize will be forfeited in its entirety (and Sponsor will have no further obligation to winner) and, at Sponsor's discretion and time permitting, may be awarded to an alternate winner. Travel and accommodation restrictions and other restrictions may apply. Each Grand Prize winner and their guest(s) must travel together on same itinerary and are responsible for obtaining all required travel documents prior to date of travel. All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Released Parties are not responsible for travel delays or cancellations. In the event an event is postponed and rescheduled, the applicable trip will be rescheduled. In the event ane vent is postponed and not rescheduled, no compensation or substitution for such portion of the prize will be provided; however, the remainder of prize package will be awarded, and Sponsor will have no further obligation to winner. Exact seat locations at any event are at Sponsor’s sole discretion. Each Grand Prize winner and his/her guests must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Released Parties reserve the right to remove or to deny attendance to any winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game. Game tickets are subject to the terms and conditions specified thereon. If unused, game tickets cannot be returned.

Resale of game tickets is strictly prohibited. All NFL tickets are subject to certain terms and conditions as specified thereon. Each Grand Prize winner and guest(s) must abide by all venue policies and regulations, including without limitation all health and safety protocols, and ticket terms and conditions at all times.  Sponsor reserves the right to revoke a full or partial prize from any winner or guest who the Promotion Sponsor, venue personnel or the NFL Entities deem in any of their sole discretion, may be intoxicated, be a safety risk, have violated any venue or NFL policy or law, fail to comply with the NFL’s (or its designee’s) health and safety protocols, or bring the Released Parties into disrepute. For the avoidance of doubt, unused tickets cannot be refunded, exchanged or applied towards tickets for any subsequent NFL event or for cash.

Grand Prize winners and each of their guests irrevocably waive all claims against the Sponsor and the NFL Entities, and agree that Sponsor and the NFL Entities will have no liability or responsibility for any claim arising in connection with participation in this Promotion, the prizes awarded, personal injury, or wrongful death, a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof, and sickness arising as a result of participant’s participating in the Promotion and related activities (e.g., travel), wherever, whenever or however the same may occur.  Each Grand Prize winner and their guest(s) fully understand that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including any protocols that will be implemented from time to time by Sponsor or NFL (collectively, the “Protocols”), can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.

All costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, (for Grand Prize winners, additional ground transportation, food, beverages, and souvenirs) are winner’s sole responsibility. Prize is awarded “as is” without any warranty or guarantee, either express or implied by Sponsor. Total ARV of all prizes awarded = $46,600.

ENTRY DETAILS: Message and data rates apply if you choose to enter using your mobile device. By entering, each entrant warrants and represents that his/her Submission does not defame or otherwise violate the rights of any third party and does not violate any federal, state or local laws or ordinances. Entrants further warrant and represent that grant Sponsor and the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, adapt, modify, publish, exploit and use the Submission in any way and in any media for trade, advertising, promotional and/or other purposes as Sponsor and/or its designees may determine without further consideration, notification or permission of entrants, winner or any third parties. The name of the “authorized account holder” associated with any given Twitter account, Instagram account, TikTok account or email address will be deemed to be the entrant and must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, an online service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. Released Parties are not responsible for lost, incomplete, late, damaged, delayed, garbled, inaccurate, incomplete or misdirected entries, Submissions or email messages; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server or other connections including those through the Site, Twitter.com/CourtyardHotels,  Instagram.com/CourtyardHotels; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in this Promotion; printing, typographical or other errors appearing within these Official Rules or in any Promotion-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise; or the administration of the Promotion; or the processing or judging of entries or submissions. Use of any device to automate or subvert the entry process is prohibited and any entries or submissions received through such means will be void.

MISCELLANEOUS: No transfer, assignment, cash redemption or substitution of prize (or portion of prize) permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion of prize) of comparable or greater value, at its sole discretion. Failure to satisfy any of the foregoing, comply with these Official Rules or any prize or prize notification being returned as non-deliverable or Sponsor being unable to contact potential winner within a reasonable time period for any reason will result in prize being forfeited. By participating, each entrant acknowledges and agrees: (1) to be bound by these Official Rules and the decisions of the Sponsor and judges which are final and binding in all respects; (2) that their Submission (and all components thereof) will not be acknowledged or returned; (3) that Released Parties and their respective designees shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, city and state of residence, photograph and/or likeness for advertising and/or trade and/or any other purpose in any media now or hereafter known without further compensation, permission or notification to entrants or any third parties; and (4) the Released Parties shall have no liability and will be held harmless by entrants for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of entrant’s participation in this Promotion, the use of any Submission or acceptance, possession, use or misuse of a prize (including any travel/activity relates thereto). Sponsor reserves the right, in its sole discretion, to void suspect Submissions or to modify, cancel, terminate or suspend the Promotion (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the Promotion and, in the event of such cancellation, suspension or termination, at its discretion, as applicable, determine the applicable Grand Prize winners using the Judging Criteria above or selecting Sweepstakes Prize winners in a random drawing from among all non-suspect, eligible Submissions received prior to event requiring cancellation, termination or suspension. CAUTION: ANY ATTEMPT BY ANY PERSON OR PERSONS, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR, AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK ANY AND ALL REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
